These Service Technician Terms and Conditions constitute a legally binding agreement under the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Digital Personal Data Protection (DPDP) Act, 2023.
This agreement is executed between the platform owner ("LENSKARE") and the independent local technician or service agency ("Technician").
1. Nature of Relationship (Independent Contractor)
- No Employment: The relationship between the Company and the Technician is strictly that of an independent contractor. Nothing in this agreement creates a partnership, joint venture, employer-employee, or agency relationship.
- No Exclusivity: The Technician remains free to provide installation services to other platforms, businesses, or direct customers, provided it does not cause a conflict of interest during a scheduled platform booking.
2. Onboarding, Verification, and Eligibility
- Documentation: Technicians must submit valid identity proof (Aadhaar Card, PAN Card), permanent address proof, bank account details, and any technical certifications or business licenses required for electronic installations.
- Background Verifications: The Company reserves the right to conduct independent background checks, criminal record verifications, and trade skill assessments before approving onboarding.
- App Access: Approved Technicians will be granted limited access to the Technician Portal/App to view, accept, and update assigned installation tasks.
3. Scope of Work and Performance Standards
- Execution of Service: Technicians must execute the installation strictly according to the guidelines, checklists, and safety protocols specified for each electronic product category on the app.
- Tools and Equipment: Technicians must arrange and bring their own professional tools, drilling equipment, safety gear, and diagnostic instruments required to complete the installation.
- Timeliness: Technicians must arrive at the customer's location within the confirmed scheduled time window. Any delays must be updated on the app immediately.
4. Mandatory Quality & Star Rating Maintenance
- Minimum Threshold: To ensure high-quality service delivery, Technicians are evaluated by customers after every installation job. Technicians must consistently maintain an average platform rating of at least 4.0 stars.
- Performance Warnings: If a Technician's rating drops below 4.0 stars, the Company will issue a formal digital warning and may temporarily restrict high-value job allocations.
- Deactivation for Low Ratings: Failure to improve and restore the average rating to 4.0 stars or above within 30 days or the next 5 assignments will result in automatic and permanent deactivation of the Technician's app account.
5. Zero Platform Liability for On-Site Accidents & Insurance
- No Accidental Insurance: The Company does not provide any accidental insurance coverage, medical insurance, or life insurance to the Technician or their helpers.
- Assumption of Risk: The Technician acknowledges that on-site technical installations involve inherent physical risks (including electrical shocks, height hazards, and tool injuries). The Technician accepts assignments entirely at their own risk.
- Absolute Liability Waiver: The Company accepts zero financial or legal liability for any personal injury, permanent disability, or accidental death suffered by the Technician while traveling to, executing, or returning from a platform-assigned installation. The Technician is strongly advised to secure their own independent commercial/personal accident insurance policy.
6. Customer Interaction, Photography, and Data Safety
- Adult Presence: The Technician must verify that a legal adult (aged 18 or older) is present inside the property before commencing any work.
- On-Site Photography: Technicians are required to take before-and-after photographs of the electronic product and the installation site through the Technician App. These photos are mandatory for service verification and payout processing.
- Handling Wi-Fi Credentials: For smart/connected devices, the Technician may ask the customer to enter their local Wi-Fi credentials into the product. The Technician is strictly prohibited from writing down, saving, or recording customer Wi-Fi network names or passwords on any external device.
- Customer Data Privacy (DPDP Act): Technicians receive limited customer data (name, installation address, contact number) strictly to fulfill the service. Technicians must not save customer phone numbers or contact them post-service for personal or independent business reasons.
7. Zero-Tolerance Code of Conduct
- Anti-Discrimination: Technicians have the right to work in an environment free from bias. Conversely, Technicians must not discriminate against, harass, or abuse any customer or platform representative based on caste, race, religion, color, gender, age, or regional origin.
- Safety First: If a Technician faces active discrimination, threats, or a hostile/unsafe workspace inside a customer's property, they have the right to immediately cease work, exit the premises, and report the incident via the Technician App.
- Prohibited Behavior: Technicians shall not solicit direct cash tips, demand extra charges from the customer for standard inclusions, or cross-sell non-platform services/parts on-site.
8. Service Fees, Late Cancellations, and Payouts
- Service Fees: The Technician will be paid a predetermined flat fee per successful installation, as displayed and accepted inside the app dashboard prior to booking confirmation.
- Customer Cancellations (Late Fee): If a booking is cancelled or rescheduled by the customer less than 24 hours before the window, or if the customer is unavailable on-site (customer unreadiness), the Technician will receive a late compensation fee of INR 250.
- Technician No-Shows / Late Cancellations: If the Technician cancels an accepted booking less than 24 hours before the slot or fails to show up, the platform reserves the right to levy a penalty deduction of INR 250 against the Technician's portal ledger.
- Payout Cycle: Approved service earnings and late compensations will be aggregated and credited directly to the Technician's verified bank account on a weekly settlement cycle, subject to applicable Tax Deducted at Source (TDS) under Indian income tax laws.
9. Damage, Warranties, and Liabilities
- Workmanship Warranty: The Technician provides an unconditional 7-day workmanship warranty on the installation. If a customer reports a loose connection or installation defect within 7 days, the Technician must perform a corrective visit without any additional fee.
- Property Damage Indemnity: The Technician assumes full financial and legal liability for any accidental property damage (e.g., pipe punctures, cracked walls, broken items) or physical injuries caused by their negligence during the installation process. The Company will deduct repair costs directly from the Technician's pending payouts.
10. Governing Law and Dispute Resolution
- Mumbai Jurisdiction: This agreement is governed entirely by the laws of India. Any legal disputes or claims arising between the Company and the Technician are subject to the exclusive jurisdiction of the civil courts in Mumbai, Maharashtra.
- Termination: The Company reserves the absolute right to deactivate a Technician's portal account instantly and permanently for rating degradation under 4.0 stars, background verification failures, code of conduct breaches, or financial fraud.
