This Privacy Policy describes how our platform collects, stores, uses, discloses, and protects the personal and professional data of independent local technicians ("Technicians"). It is strictly structured to comply with the Digital Personal Data Protection (DPDP) Act, 2023 and the Information Technology Rules, 2011.
Under this policy, the Technician is the Data Principal, and the platform company acts as the Data Fiduciary.
1. Data We Collect from Technicians
To onboard you, verify your skills, and route customer service requests to you via the app, we collect the following datasets:
- Identity and KYC Data: Full name, Aadhaar card number, PAN card, permanent/current residential address, and profile photograph.
- Professional Credentials: Technical certifications, trade diplomas, previous work experience records, and corporate business license details (if operating as a service firm).
- Financial and Payout Data: Bank account details (Account number, IFSC code), cancelled cheques, and tax numbers for TDS processing.
- Real-Time Geolocation Data: Live tracking of your location via the mobile app to assign installation jobs near your vicinity and track your transit route to the customer's doorstep.
- Performance Metrics: Average customer star ratings, turnaround time per installation, history of job completions/rejections, and history of late cancellation penalties.
- On-Site Operational Data: Logs of before-and-after photographs uploaded by you through the technician portal to confirm successful product installations.
2. Legal Basis and Purpose of Data Processing
We process your data strictly under the legal grounds of Notice and Consent as per Section 6 of the DPDP Act, 2023, for the following distinct operational purposes:
- Background Verification: To execute mandatory criminal background verifications and trade-skill legitimacy checks before permitting platform access.
- Job Routing & Matching: To track your real-time geolocation to match you with nearby customer installations in Mumbai.
- Financial Settlement: To process your weekly payouts and execute legally mandated Tax Deducted at Source (TDS) filings.
- Quality Assurance Monitoring: To track your average star rating against the mandatory 4.0-star threshold to maintain platform service standards.
- Dispute and Audit Trails: To store the before-and-after installation photos you upload, protecting you and the platform against consumer property damage claims.
3. Data Sharing and Third-Party Disclosures
We respect your privacy and enforce absolute boundaries on who can access your personal data:
- With Consumers: The platform shares your name, masked contact number (via an in-app calling mask system), profile picture, and average star rating with the customer once you accept their installation request. Your permanent address and banking info are never shared with consumers.
- With Third-Party Verification Providers: Your Aadhaar, PAN, and address histories are shared securely with authorized background verification companies during onboarding.
- Legal and Law Enforcement Compulsion: We will disclose your complete identity and performance file to the police or judicial courts in Mumbai only if ordered by a formal, legal mandate.
4. Strict Data Security and Indian Localization
- Storage Location: In alignment with Indian data privacy statutes, all technician personal, financial, and background datasets are stored and processed on secure cloud servers physically located inside the borders of India.
- Security Controls: We implement multi-factor authentication (MFA) for your app dashboard access, End-to-End Encryption (E2EE) on personal documents, and automated firewalls to block unauthorized external access.
5. Data Retention Boundaries
- Active Retention: We retain your active profile, geolocation logs, and rating metrics for the entire duration you remain registered on our portal.
- Post-Termination Archive: If your account is deactivated (voluntarily or due to dropping below the 4.0-star rating), your financial ledger history and identity documents are safely archived for 8 financial years to fulfill legal tax audit requirements under Indian law. Geolocation data history is purged or completely anonymized within 180 days of account closure.
6. Your Legal Rights as a Data Principal (DPDP Act, 2023)
As an independent technician on our platform, you possess clear statutory rights regarding your personal information:
- Right to Access & Summary: You can view your complete profile, active payout information, and rating statistics directly inside the app portal at any time.
- Right to Correction & Updating: If you change your phone number, residential address, or bank account, you can submit a correction request through the app accompanied by verified backing documents.
- Right to Erasure (Right to be Forgotten): You may request the absolute deletion of your personal data by submitting a formal termination request, provided you have no outstanding installations, zero pending property damage disputes, and your account balances are clear.
- Right to Grievance Redressal: You have the explicit right to register an escalated complaint with our Data Protection Officer if you believe your data has been handled carelessly.
7. Contact Details of the Grievance & Data Protection Officer
In compliance with the IT Rules and the DPDP Act, 2023, any privacy concerns or data erasure requests must be sent to:
- Title: Grievance Officer / Data Protection Officer
- Email: support@lenskare.co.in
- Address: Mumbai, Maharashtra, India.
